When the Terms and Conditions apply.
These terms and conditions (“Terms and Conditions”) shall govern the relationship between the client and everyone on whose behalf the client books a CDAT Trip (“Client” or “you”), on the one hand, and Carpe Diem Adventure Tours (“CDAT”, “we” or “our”), on the other hand, for any trip, tour, expedition or safari (“CDAT Trip”) organized directly by CDAT or through a third-party Tour Operator with which CDAT has contracted, including CDAT’s June 2022 Mt. Kilimanjaro Climb and Safari:

When you book a CDAT Trip directly with CDAT.

When you book a CDAT Trip through third-party.

When booking a CDAT Trip directly through a third-party, you automatically agree to be bound by these Terms and Conditions.

Please note that these Terms and Conditions set forth the rights and responsibilities that you have while booking and taking part in our CDAT Trip in Tanzania
2. Our Warranties and representations.
We warrant that:

We have or will contract with qualified professional third-party tour operators who have all the necessary licenses and permits to organize and run Kilimanjaro climbing expeditions and wildlife safaris in the United Republic of Tanzania. Any such designated third-party tour operator, its parent companies, subsidiaries, and assigns, and their respective employees, affiliates, officers, directors, successors, representatives, agents and assigns (collectively “Tour Operator”), in turn, acts only as an agent for any transportation carrier, hotel, ground operator, restaurants, or other suppliers of services connected with the CDAT Trip (“Other Providers”), and the Other Providers are solely responsible and liable for providing their respective services.

All our Kilimanjaro guides, wildlife safari driver-guides and consultants have professional training in the respective fields.
Our programs also actively support community development projects in Tanzania. These include: Faraja Orphanage in Arusha.
We are environmentally friendly and have strict “leave-no-trace” protocols to cultivate sustainable tourism in Tanzania and reserve its natural heritage for future generations.
3. Treatment of your personal information.

We shall require certain personal information to take care of your expedition arrangements. Such information includes your full name, age, nationality, passport information, diet and medical particulars.

Parts of the information will be made available to the administration of the Tanzania wildlife areas for the processing of entry permits and to the accommodation providers to make your stay comfortable.
4. Communication and correspondence.
To avoid travel scams, ensure that all and any communications with us are carried out through the following channels:

5. Booking and payment process.

The booking process begins with you signing onto our website and following the prompts. Deposit information and final payment information will be found there.

Once you have activated all the prompts to the Mt. Kilimanjaro Climb and Safari, you will be sent via email an invoice providing you with the final payment information.

Your adventure will be deemed confirmed once a deposit payment reaches our account, and you will be notified by email immediately.

The deadline for the final payment will be delineated in your email confirming that your deposit has been received.

A partial deposit will be required by 9/18/21. This amount will be $1,500.00. This will be sent to hotels to confirm your reservations.

Final payment needs to be received no later than 3/18/22. You will be invoiced for all payments that are required. Timely payments are essential, as these funds will be used to cover hotel reservations and other CDAT Trip-related expenses. Failure to make timely payments without prior written authorization from - CDAT will result in our canceling your booking. Any deposit made may be forfeited according to our cancellation policies set forth below.

Please note that all transaction related charges applicable to your payments must be covered by you. All banking commissions for both sender and receiver must be covered by you when using wire transfers.
Participation of Minors

One must be 18 years or older to book a trip with CDAT.
-
A Minor—i.e., a person under 18 years of age—must always be accompanied and supervised by the adult Client who booked the CDAT Trip on behalf of that Minor. That Client shall be responsible for the Minor’s conduct and carry the liability for any damage that may result from said conduct. CDAT provides neither childcare nor chaperoning services.

All bookings made on behalf of a Minor are subject to our approval. The Client who booked the CDAT Trip on behalf of the Minor will be solely responsible for securing the passport, visas, permits, approvals and meeting another legal requirement that may be needed for a Minor to travel on the CDAT Trip. We shall not be liable for the failure to comply with any requirements that may prevent a Minor’s entry into or exit from Tanzania.
PRICES:
All prices are (i) quoted in U.S. dollars, (ii) estimates based on tariffs, park fees, taxes, currency values and third-party charges, and (iii) subject to change prior to booking. Notification of the current cost relevant to the CDAT Trip will be provided to you at the time of booking. After booking, if it is necessary to levy additional costs, CDAT reserves the right to do so, and notification will be given, to the extent reasonably possible, at the time of final invoicing or as soon thereafter as reasonably possible.

3-night hotel stay at the Kilimanjaro Wonders Hotel - all meals included.

Full guide and porter team to carry heavy items (e.g., tents, meals) during the Mt. Kilimanjaro climb. You will be responsible for carrying personal items during the climb.

All meals, water and permits during your climb.

4 season tents (on a sharing basis unless otherwise agreed, see below), sleeping bag, and mat.

Duffel bag to repack your gear when you arrive and before the Mr. Kilimanjaro climb.

All ground transportation during the CDAT Trip.

Transport with a qualified driver/guide in 4X4 vehicles with a viewing roof during the safari.

Changes to the itinerary
-
The itineraries and accommodations presented in the documentation regarding the CDAT Trip or on the website are subject to modification and change by CDAT or the Tour Operator. Every reasonable effort will be made to operate CDAT Trips as planned, but alterations may still occur after final itineraries are sent.

If you miss any tour service, sightseeing or meal. Or fail to use any other service acting on your own account, no refund will be provided.
Cancellations
1.If you decided to cancel you travel arrangements with us, the following cancellation fees shall apply:
-
90% refund of your payment if you cancel at least 180 before the departure date.
-
70% refund if you cancel between 179 and 90 days before the departure date.
-
50% refund if you cancel between 89 and 60 days before the departure date.
-
No refund if you cancel 30 days prior to the departure date.
You must advise us in writing of your cancellation. All cancellation requests must be received in writing and will become effective as of the date of the postmark or email date stamp.

If you provide documentation substantiating that you are prohibited from travelling due to the COVID-19 pandemic (e.g., by travel restrictions imposed by the government, infection substantiated by a positive COVID-19 PCR test performed by a licensed medical practitioner, mandatory quarantine) we will return all payments you have made to us, excluding CDAT Trip related expenses paid by CDAT before we received your written cancellation request (e.g., non-refundable hotel reservations, purchases for the Mt. Kilimanjaro expedition, etc.).
Cancellation by CDAT
CDAT reserves the right to cancel any CDAT Trip for any reason, including, but not limited to, because of inadequate enrollment that makes the CDAT Trip economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the participants. If a CDAT Trip is canceled prior to departure, CDAT or the Tour Operator will provide you with a full refund of monies paid to CDAT.

If CDAT or the Tour Operator cancels the CDAT Trip in progress, you will receive a prorated refund based on the number of days not completed on the CDAT Trip. If you elect to leave a CDAT Trip in progress of your own volition, you will not receive any type of refund. If CDAT or the Tour Operator cancels the CDAT Trip in progress and you elect not to immediately return to your original point of departure for the CDAT Trip, or if you elect to leave a CDAT Trip in progress of your own volition, you acknowledge and agree that (i) you shall be solely responsible for your travel plans once you depart the CDAT Trip, (ii) neither CDAT nor the Tour Operator shall have any responsibility for or control over your safety or activities once you depart the CDAT Trip, and (iii) you release and hold harmless the “Released Parties” (as defined below) and the Tour Operator, from any and all costs, liability, loss, damage, injury, or death that may arise out of your decision to not return to your original point of departure from the cancelled CDAT Trip in progress. Except as outlined above when CDAT cancels a CDAT Trip, the Released Parties and the Tour Operator have no responsibility for any expenses, including any non-refundable expenses, incurred by you in preparing for a cancelled CDAT Trip or for any additional arrangements should you embark prior to the scheduled group departure date.
Travel documents, visa, and entry to Tanzania
You are solely responsible for obtaining and paying for any documents required for your participation in the CDAT Trip such as a valid passport, all visas, vaccination certificates, and any other documents. Further, you are solely responsible for obtaining current travel advisories, warnings and requirements by contacting your travel agent, applicable embassies and consulates. You are strongly encouraged to visit the U.S. State Department’s website at http://travel.state.gov and the U.S. Centers for Disease Control and Prevention (CDC) website at http://www.cdc.gov. Non-U.S. residents please consult the appropriate consulates regarding passport, visa and other document requirements. You must have valid government-issued proof of citizenship to travel, in addition to any other requirements of the country of origin and countries visited. Those without proper documentation may be denied travel. In addition, you may be denied entry to the countries visited if they do not meet the country’s entry requirements. Failure to obtain documents does not negate these Terms and Conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be your responsibility.
No information published on our website about visas, vaccinations or other entry requirements should be viewed as a warranty or representation.

CDAT shall not be liable if you are denied entry to Tanzania or any other country on the way to Tanzania for whatever reason. You also agree that if you fail to enter the country for whatever reason, no refunds will be made. It will not be possible to reschedule your CDAT Trip because we will have prepaid all the park fees, and other expenses incurred by the time of your arrival.

Accommodation
Accommodation in hotels

Our prices include accommodation on a sharing basis in a double or twin room with your fellow travelers. If you travel alone, we will match you with a same-sex traveler to share a room. If you want to stay in your room alone, please inform our managers at the time of booking. Extra charges for staying in your room alone may apply.

Accommodation type and setup for our private adventures are agreed with our consultants individually.

Our Safari and Kilimanjaro climbing tour includes hotel accommodations as described in the respective travel packages on our website. In some cases, however, those hotels may be fully booked. We will notify you and pick an alternative hotel.
Tented Accommodation on Mount Kilimanjaro

Our Kilimanjaro climbing packages include tented accommodation on a sharing basis (2 travelers per tent). You will share a tent with your fellow traveler. If you travel alone, we will match you with a same sex traveler to share a tent.

If you want to stay in a tent alone, please inform our managers at the time of booking. Extra charges to stay in a tent alone will apply.
Fitness and Medical Information

1. By registering for a CDAT Trip, you certify that you do not have any mental, physical, or other condition or disability that would create a hazard for yourself or other participants. CDAT and the Tour Operator reserve the right in their sole discretion to accept, decline to accept, or remove any participant on a CDAT Trip. CDAT and the Tour Operator reserve the right, without penalty or being obligated to provide a refund, to make changes in the published itinerary whenever, in their judgment, conditions warrant or if they deem it necessary for the comfort, convenience, or safety of the participants. It is your own responsibility to determine where you are physically fit for a Kilimanjaro climb or a wildlife adventure and assess your health conditions. We recommend seeking a qualified medical opinion if you are not sure. You will not receive a refund for any portion of the CDAT Trip in which you voluntarily elect not to participate.

2. We may also ask you to provide certain medical information and to compete our medical form. If you have any pre-existing medical condition that may have an impact on your ability to visit mountainous or remote regions of Tanzania, that could potentially put yourself and/or other tour participants in danger, we may ask you to have the form signed by a licensed medical practitioner.

3. Failure to provide the medical form and having it signed by a licensed medical practitioner may result in the cancellation of your CDAT Trip with applicable cancellation fees, as shown in the Cancellation’s clause of the Terms and Conditions.

4. All medical information provided will be treated in accordance with the “Treatment of your personal information” clause of these Terms and Conditions.

5. We may cancel your participation in our tours without any refunds in the following situations:

If we discover that the medical information provided to us is false, inaccurate or incomplete.
-
If, while taking part in our tour, your medical condition deteriorates to the extent that it puts yourself and/or other tour participants in danger.
6. You will need to cover any costs relating to the cancelation.
​
7. If you have any special medical or dietary requirements, it is your responsibility to inform us within 30 days before your scheduled arrival in Tanzania. We shall make reasonable efforts to accommodate your special requirements. For example, for those following a special diet, we will attempt to provide vegetarian, vegan, gluten-free and halal meal plans where reasonably available.

8. You also agree that you have been sufficiently informed that some facilities and services, to which you may be accustomed to in your country, may be currently unavailable or inaccessible in Tanzania.
​
9. In the event you become sufficiently incapacitated as to be unable to direct your own care, there is no one on the CDAT Trip who can direct your care and CDAT is unable or does not have time to contact your emergency contact, you authorize, by registering and paying a deposit for a CDAT Trip, any medical treatment deemed necessary in the event of any injury or illness while participating in the activity including, but not limited to, X-ray, examination, anesthetic, medical or surgical diagnosis, or treatment and hospital care which is deemed advisable by, and is to be rendered under the general or specific supervision of, any physician and/or surgeon licensed in the United States, or, if in a foreign country and no physician licensed to practice in the United States is reasonably available, by a physician duly licensed in that foreign country. In addition, you certify that you have medical insurance which will cover personal accidents, medical expenses, medical evacuation, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you, or that in the absence of this medical insurance coverage, you agree to pay all costs of rescue and/or medical services as may be incurred on your behalf.
Travel Insurance

Having travel insurance is mandatory for participation in CDAT Trips. We may disqualify you from taking part in our adventure without any refund if you do not have a proper insurance package.

Remember that insurance is not generally included in our travel packages. This service is available as an extra add-on .
-
Such insurance should cover emergency medical expenses for any personal injury, evacuation and repatriation, cancellation and curtailment and other reasonable expenses.
-
Your CDAT Trip includes climbing Mt. Kilimanjaro, and your insurance package should cover high-altitude trekking (up to 6,000m/19858ft) and helicopter evacuation.
-
You should also make sure that your insurance package provides sufficient coverage against all other relevant risks. It is also your responsibility to keep your insurance provider sufficiently informed of your travel plans and the nature of hazards and risks involved.

If any insurance case happens, it will be your responsibility to inform your insurance provider and to comply with all procedures relating to indemnification/reimbursement. We shall provide reasonable assistance but shall not be responsible for any outcome of the insurance claim whatsoever.
Vaccinations
Part of planning your trek should involve doing some research in to what the recommended vaccinations for Kilimanjaro/Tanzania are and consulting your doctor for a health check.

All climbers should have a medical check prior to attempting to climb the mountain. Ask your doctor if high altitude trekking is permissible for your age, fitness level and health condition. Ask if you have any pre-existing medical conditions that can cause problems on the climb. Ask if any of your medications can affect altitude acclimatization. Ask whether Diamox can be taken with your existing prescription medicines.

Vaccination requirements for Tanzania change and it is important you visit your doctor or local travel clinic to discuss what vaccinations and drugs you will require. There is also a risk of contracting Malaria while visiting Tanzania and precautions should be taken.
Authorities and our Guides

It is important and mandatory to follow all safety and instructions and rules of CDAT and the Tour Operator’s guides. A guide’s decision in all arrangements, team management, itinerary, objectives and any other CDAT Trip-related matter while on the CDAT Trip will be final.

If in the opinion of a guide, your physical condition or certain actions may be reasonably harmful or dangerous to yourself or other tour participants, the chief guide may decide that you should descend from the Kilimanjaro climb (his assistant and some porters will be helping you with the descent). No refund will be provided in this case.

You accept all risk of travel to Tanzania

You understand that your adventures with us may involve visiting remote areas (National Parks, rural regions, etc.), where the standards of medical assistance may be different from those available in your home country or may be unavailable at all.

In addition to that, you also acknowledge that some adventures offered by us may involve certain risks (for example wildlife, high altitude, etc.) to your health and safety. You agree that you have carefully evaluated all of those risks and assume full responsibility for them.

You release us from all claims and causes of action, which may arise from any losses, damages, injuries or death which may the result from the risks inherent to your travels in Tanzania.

CDAT and its owners, affiliates, and assigns, and their respective employees, officers, directors, successors, representatives, and agents (collectively the “Released Parties”) and the Tour Operator will not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any Other Provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such Other Provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. The participant waives any claim against the Released Parties and/or the Tour Operator for any such loss, damage, injury, or death.

Neither the Released Parties, nor the Tour Operator, will be liable for any air carrier's cancellation penalty incurred by the purchase of a ticket to or from your departure city. Baggage and personal effects are always your sole responsibility.

If you elect to participate in any additional activity or excursion that is not arranged or led by CDAT or the Tour Operator, neither the Released Parties nor the Tour Operator shall have any responsibility for or control over your safety or well-being, and you release and hold harmless the Released Parties and the Tour Operator from any and all costs, liability, loss, damage, injury, or death arising from your decision to participate in such activity or excursion.
Your liability for damaged or destroyed property
1.We will charge you if you willfully destroy or damage CDAT or the Tour Operator’s property, for example, the Kilimanjaro tents, safari vehicles, personal expeditions gear that you may rent, hotel furniture, items and appliances and so on. You will indemnify and defend CDAT and the Tour Operator for any damage caused.
Money for regular travel expenses
You acknowledge that you should have a reasonable amount of money with you to cover incidental and regular travel expenses, for example, souvenirs, tips, meals if not included, alcoholic drinks, etc. We shall not be responsible for your failure to cover any expenses of that nature for whatever reason.
Your luggage and valuables

We shall not be responsible for any items, including but not limited to luggage and valuables, lost, destroyed or delayed by the airliner or any transportation provider other than CDAT.

In addition, neither are we responsible for being in touch with the airline checking the status of your lost/delayed items, nor are we responsible for transporting them to the hotel after it arrives. If your luggage arrives later than you, you will need to pay a luggage delivery fee for transporting the luggage from the airport to the hotel.

You are responsible for keeping your valuables, such as money, gadgets. jewelry, and other personal possessions or luggage while taking part in our adventure. We shall not be responsible for any lost, stolen or damaged property.

You may ask our managers to accept your valuables, and personal possessions or luggage for safekeeping. In such a case, we will lock them in our company safe, which is under the constant video surveillance and alarm. We will assume full responsibility for your property entrusted into our care.

Images and Marketing
You understand that CDAT , the Tour Operator and other CDAT Trip participants may take photos, videos, and other media images during our the CDAT Trip. These photos and videos may have your image. By taking part in our CDAT Trip, you agree that we and the Tour Operator may use these media materials for marketing, promotion and advertising without any royalty or other payments to you.
The Laws of California shall apply
The laws of the State of California shall apply in the case of any disputes arising out of the CDAT Trip or these Terms and Conditions.

Severability
If any portion of these Terms and Conditions is held, determined or adjudicated to be invalid, unenforceable or void for any reason whatsoever, each such portion, provision or part shall be severed from the remaining portions, provisions or parts of these Terms and Conditions, and shall not affect the validity or enforceability of any remaining portions, provisions or parts.
